1. Acceptance of Terms
By accessing and using the Diaspora Nearby mobile application and web platform ("App"), developed and published by Peter Swai ("Developer," "we," "our," or "us"), you agree to be bound by these Terms of Service and our Child Safety Standards Policy. If you do not agree to these terms, please do not use the App.
2. Description of Service
Diaspora Nearby is a location-based social networking platform that connects diaspora communities globally.
The App allows users to discover nearby community members, communicate, attend events, access marketplace
services, and earn $DIASPORA tokens through Proof of Social Activities (PSA) and Proof of Community Trust (PCT).
3. User Accounts & Age Eligibility
- You must be at least 18 years old to register for an account, access peer hosting/marketplace features, or participate in community governance on Diaspora Nearby (or at least 13 years old where permitted by applicable local law, subject to strict child safety protections).
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration.
- One account per person. Multiple accounts are prohibited.
4. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
- Upload, post, transmit, share, solicit, or otherwise make available any content that involves Child Sexual Abuse and Exploitation (CSAE) or Child Sexual Abuse Material (CSAM), or engage in any conduct that harms, exploits, grooms, or endangers minors in any way.
- Harass, abuse, stalk, or threaten other users.
- Impersonate another person or entity.
- Distribute spam, malware, or other harmful content.
- Attempt to manipulate the $DIASPORA token economy through fraudulent activity.
- Create automated accounts or use bots to interact with the platform.
5. Child Safety Standards & Zero-Tolerance Policy Against Child Sexual Abuse and Exploitation (CSAE)
Diaspora Nearby (developed and operated by Peter Swai) maintains an absolute, zero-tolerance policy against Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Protecting children and preventing any form of minor exploitation on our platform is a top priority.
- Explicit Prohibition of CSAE and CSAM: We strictly prohibit the creation, uploading, sharing, distribution, possession, solicitation, or promotion of Child Sexual Abuse Material (CSAM) or any content, communication, or activity that facilitates or depicts Child Sexual Abuse and Exploitation (CSAE). This includes, without limitation:
- Any visual depiction (photos, videos, AI-generated or computer-generated imagery, or illustrations) of sexually explicit conduct involving a minor (anyone under the age of 18).
- Predatory behavior, online grooming, inappropriate interaction with minors, sexual solicitation of minors, child sextortion, or child sex trafficking.
- Sharing links, external URLs, invite codes, or references to off-platform resources that host or promote CSAM or CSAE.
- In-App Reporting & User Feedback Mechanism: Diaspora Nearby provides built-in, easily accessible in-app reporting tools across the entire application. Users can report any suspected child safety concern, CSAE/CSAM violation, abusive message, profile, community chat, or post directly within the App by tapping the Report / Block User action on any user profile, direct message, community post, or event, or via Settings → Help & Support. Reports are prioritized and reviewed 24/7 by our Trust & Safety team.
- Enforcement & Method for Addressing CSAM: Upon detecting or receiving a report of actual or suspected CSAM or CSAE:
- We immediately remove and disable access to the offending content.
- We immediately and permanently terminate the account(s) of any user involved, blocking their phone number, email, device identifiers, and wallet addresses from re-registering on Diaspora Nearby.
- We preserve relevant digital evidence and account records in accordance with applicable legal obligations.
- Mandatory Reporting to NCMEC & Law Enforcement Compliance: Diaspora Nearby complies with all applicable regional, national, and international child safety laws and regulations (including 18 U.S.C. § 2258A). We promptly report all apparent or suspected instances of CSAM and CSAE to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline (www.cybertipline.org) as well as to relevant national and regional law enforcement authorities worldwide.

6. $DIASPORA Tokens (DSP)
- $DIASPORA tokens are earned through on-platform activity and are not purchased.
- Pre-TDE DSP points are not transferable and have no cash value until the Token Distribution Event (TDE).
- The distribution rate during TDE releases is determined by your Trust Score: scores 1-10 convert at 0%, scores 11-90 convert at the exact Trust Score percentage, and scores 91-100 convert at 100%.
- We reserve the right to modify token distribution mechanics with community notice.
7. Content and Intellectual Property
- You retain ownership of content you create and share on the platform.
- By posting content, you grant Diaspora Nearby a non-exclusive license to display and distribute that
content within the platform.
- All platform branding, design, and technology are the intellectual property of Diaspora Nearby.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how
we collect, use, and protect your personal information, including location data.
9. Limitation of Liability
Diaspora Nearby is provided "as is" without warranties of any kind. We are not liable for any indirect,
incidental, or consequential damages arising from your use of the App, including but not limited to the
value or conversion of $DIASPORA tokens.
10. Termination
We reserve the right to suspend or terminate your account for violations of these terms, including any violation of our Child Safety Standards (CSAE/CSAM policy), fraudulent activity,
or any conduct that undermines the trust and safety of the community.
11. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the App after changes constitutes
acceptance of the revised terms.
